1. Agreement & Service Description
By accessing or using DeadSender, you agree to be bound by these Terms of Service. DeadSender is a secure scheduled message delivery service that enables you to create encrypted messages for designated recipients, set check-in schedules, and ensure your messages are delivered when you're no longer able to do so yourself.
2. Account Registration
To use DeadSender, you must:
- Provide accurate and complete registration information
- Maintain the security of your password and account
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized use
You must be at least 18 years old to create an account.
3. Subscription Plans
We offer three subscription options:
- Monthly: $5 USD/month, billed monthly
- Annual: $49 USD/year, billed annually
- Lifetime: $199 USD one-time payment
All plans include full access to all features. Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
4. Payment Terms
- Payments are processed through Stripe (credit/debit cards) or OpenNode (Bitcoin)
- All fees are in USD unless otherwise stated
- We provide 30-day notice for price changes
- You are responsible for any applicable taxes
- Cancel anytime — access continues until the end of your billing period
5. Cancellation & Refund Policy
You may cancel your subscription at any time. Upon cancellation, you will retain access to DeadSender until the end of your current billing period. No partial refunds are issued for unused time.
Lifetime purchases are non-refundable. If you experience a technical issue that prevents you from using the service, please contact us at support@deadsender.com.
6. User Content
You retain all rights to the content you create in DeadSender, including messages, attachments, and recipient information. By using our service, you grant us a limited license to store, process, and transmit your content solely to provide the service.
You warrant that:
- You own or have rights to all content you upload
- Your content does not violate any third-party rights
- Your content complies with applicable laws
7. Message Delivery & User Responsibility
DeadSender will attempt to deliver your messages to designated recipients according to your check-in schedule and delivery settings. By creating a message, you authorize us to:
- Store your encrypted messages securely
- Send check-in notifications to you via email, SMS, phone, and push notifications
- Deliver your messages to recipients when delivery conditions are met according to your configuration
- Provide recipients with access to your message content and attachments
You acknowledge and agree that:
- You are solely responsible for completing check-ins on time, maintaining accurate contact information, and configuring your check-in schedule, delivery rules, and recipient list appropriately.
- Messages may be delivered whenever the conditions you configured are met — including if you fail to receive, see, or respond to a check-in notification for any reason (including but not limited to: inbox filtering, spam blocking, network issues, device failure, travel, illness, or simple oversight).
- You are solely responsible for the content of your messages and for ensuring you have the right to share any information included in them.
- Delivery may occur at times you did not anticipate. Once a message is delivered, it cannot be recalled.
- DeadSender has no way to verify whether a check-in was intended or missed in error, and will act solely on the basis of whether a check-in was recorded by our system within the configured window.
- You assume all risk associated with the consequences of message delivery, including any personal, professional, financial, or legal consequences that may result from a recipient receiving a message.
We strongly recommend regularly testing your check-in process, keeping your contact methods current, and reviewing your scheduled messages and delivery conditions to ensure they reflect your current intentions.
8. Prohibited Uses
You may not use DeadSender to:
- Violate any laws or regulations
- Harass, threaten, or harm others
- Transmit malware or malicious content
- Impersonate others or misrepresent your identity
- Interfere with the service or circumvent security measures
- Send spam or unsolicited messages to recipients
- Store or transmit illegal content
9. Intellectual Property
DeadSender, including its design, features, and code, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our service.
10. Privacy
Your use of DeadSender is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. For critical message delivery, we maintain redundant systems and contingency plans.
12. Termination
You may cancel your subscription at any time through account settings or by contacting support@deadsender.com. We may terminate or suspend your account for violations of these terms.
Upon termination, your messages will not be delivered and your data will be deleted within 30 days unless you have pending scheduled deliveries.
13. Disclaimer of Warranties
DeadSender is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or timeliness.
We make no guarantees regarding message delivery, timing, or non-delivery. Specifically, we do not warrant that:
- Messages will always be delivered when you expect them to be
- Messages will never be delivered when you do not expect them to be
- Check-in notifications will always reach you
- The service will be uninterrupted, error-free, or secure against all threats
- Recipients will receive, read, or act upon any delivered message
- Delivery timestamps, content, or records will be free of error
14. Limitation of Liability
To the maximum extent permitted by law, DeadSender, its operators, owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the service, including but not limited to:
- Messages being delivered when you did not intend them to be (including due to missed or failed check-ins for any reason)
- Messages failing to be delivered when you intended them to be
- Content of your messages causing personal, professional, reputational, financial, or legal harm to you, recipients, or any third party
- Loss of data, profits, business opportunities, relationships, employment, or goodwill
- Recipients' responses, actions, or inactions upon receiving a delivered message
- Errors, delays, or interruptions in the service
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and regardless of whether we were advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising from or related to the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.
15. Indemnification
You agree to indemnify, defend, and hold harmless DeadSender and its operators, owners, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of or inability to use the service
- Any content you create, store, or cause to be delivered through the service
- Any dispute between you and a recipient, or between you and any third party relating to a delivered or undelivered message
- Your failure to check in, your configuration of the service, or any claim that a message was delivered in error
- Your violation of these terms or any applicable law
16. Governing Law & Disputes
These terms are governed by the laws of Japan. Any disputes shall be resolved through binding arbitration in accordance with the rules of the Japan Commercial Arbitration Association, except where prohibited by law.
17. Changes to Terms
We may update these terms periodically. Material changes will be communicated via email or prominent notice on our website. Continued use after changes constitutes acceptance.
